Web Hosting Terms
Superior-Host International:
Superior-host.com provides web hosting to over 2000 web sites,
and we have a responsibility to protect each client and to
provide the best services available. The following guidelines
were designed to ensure these obligations are met.
All services provided by Superior-host.com may be used for
lawful purposes only. Transmission, storage, or presentation of
any information, data or material in violation of any United
States Federal, State or City, or any International laws is
prohibited. This includes, but is not limited to:
Copywrited material, material we judge to be
threatening or obscene, or material protected by trade secret and
other statute. The subscriber agrees to indemnify and hold
harmless Superior-host.com from any claims resulting from the use
of the service which damages the subscriber or any other
party.
Pornography:
Pornography is prohibited on all Superior-host.com servers.
If you are unsure whether or not your site falls
into this category, feel free to contact us with a description
before signing up for an account or publish material as an
existing customer. If needed, we will inspect the content of the
site to let you know.
Also prohibited, are sites that promote
any illegal activity or present content that may be damaging
to Superior-host.com servers or any other server on the
Internet.
Examples of unacceptable content or
links:
Pirated
software.
Pornography- Links to pornography sites.
Violations of
Copyrights.
Hacker programs or
archives.
Warez
sites.
Hate
propaganda.
MP3 and other types of sites designed for downloading
of material by a mass user group. This includes but is not
limited to, Music, video, audio, Software or Freeware or
Shareware, Free Images and backgrounds, and anything else that
makes it an excessively high bandwidth site with the sole purpose
to distribute freely products for download.
Some sites would just be too busy to host on our machines. Ask
first.
Sites that use a lot of the cpu load and or ram memory cause
the server to load sites too slow. Also, sites with several large
mail lists can cause slowness. It is at our discretion, that if a
site uses too much resource, no matter what the cause, we may
need to move the site to another of our servers, or in many
cases, we will ask for them to find a new host.
All
accounts
We have found most our
customers to stay within "reasonable limits"
However, to maintain the integrity of our service, we must state
the following restrictions:
To all our accounts applies the following
restrictions:
You Must have permission
from Tim LeGrand, the owner to have;
Sites with cgi's
running from their domain used on other domains - Not Allowed,
Ever. ie: you can't host cgi scripts for other
sites that are on other servers.
Sites using more than 20%
of system resources. Our software will shut down a site or part
of a site that is using more than 20% of the system ram for more
than 4 minutes.
Ultimate Bulletin Board
Forums: We no longer allow these on our servers. They
consistently are a drain to the server. They look nice, but are
"System Hogs", and are not allowed. We do offer a nice
bulletin board in our control panel though.
RESELLERS:
Our site is Copywrited, and the sole property of
Superior-Host Services. We do not want mirrors of this site with
any other name. Needed wording such as our terms may be copied,
but the context and look of our pages may not be reflected on
your site(s). It is our site look, and we wish it to stay ours
until this notice is removed from the terms. Take the time to
develop your own site in your own words... Not ours.
Superior-host.com will be
the sole arbiter as to what constitutes a violation of this
provision.
Commercial
Advertising - E-mail / Unsolicited E-Mail:
Spamming, or the sending of
unsolicited e-mail, from any Superior-host.com server or using an
e-mail address or domain that is maintained on a
Superior-host.com machine as reference is STRICTLY
prohibited.
As delegated by our backbone provider, any sites using spam will
be closed. If a fine is imposed from the backbone provider, the
site owner is responsible for that amount, and we will charge the
card on file.
Superior-host will be the
sole arbiter as to what constitutes a violation of this
provision.
Spamming
WILL get your account terminated.
Chat
Rooms
Chat rooms are supplied in
the control panel pre-installed scripts. ALL chat rooms will be
monitored for bandwidth usage. Chat rooms are bad on server
resources, so if your chat room gets busy, we may need to ask you
to host it on a free chat server.
Background Running
Programs
CRON
JOBs;
We allow programs to run in
the background. These are considered on a case-by-case basis. If
they use too much server load or ram, we may contact you to disable
them, or in exstream cases we will need to disable them before
contacting you.
IRC
We DO NOT allow IRC or
IRC bots to be operated on our servers.
Server
Abuse:
Any attempt to undermine or
cause harm to a server, or customer, of Superior-host.com is
strictly prohibited. Offenders will be prosecuted to the fullest
extent of the law.
Refusal of
Service:
We reserve the right to
refuse, cancel, or suspend service at our sole
discretion.
REFUNDS:
It is our policy to refund to the customers card
all hosting fees within 6 hours of a customer canceling within the
first 30 days of hosting. If you paid for domain registration at
the time you signed up for hosting, that fee was paid to the
registry and is not refundable. The domain is yours to move to
any host you wish.
Sub-domains:
Superior-host.com reserves
the right to transfer any sub-domain in domains of its possession
to an alternative domain.
ie: yoursite.1-sh.com or yoursite.superior-host.com
Resellers:
All Sub-Networks, Resellers,
distributive hosting sites, and dedicated servers of
Superior-host.com must adhere to the above policies, and all of
our terms.
Limitation of liability:
Your use of
Superior-host.com's services are at your sole risk. All
Superior-Host.com services are provided on an "AS IS"
basis WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS,IMPLIED,
CONSTRUCTIVE, OR STATUTORY, INCLUDING,WITHOUT LIMITATION, ANY
IMPLIED WARRANTIES OF MERCHANTABILITY, NON INFRINGEMENT OR
FITNESS FOR A PARTICULAR PURPOSE. Superior-Host offers a 30 day
money back guarantee, no other warranty applies.
It is up to you to keep a backup copy of your site. We make this simple by giving you tools in your control panel to download a copy of your website, and all your databases for YOUR safety.
Superior-host.com makes no
guarantee of availability of service and reserves the right to
change, withdraw, suspend, or discontinue any functionality or
feature of the Superior-host.com service.
In no event will
Superior-host.com - Superior-Host Services be liable for any
damages, including without limitation, direct, indirect,
incidental, special, consequential, or punitive damages arising
out of the use of or inability to use Superior-Host.com's -
Superior-Host Services, services or any content thereon.
This disclaimer applies, without limitation, to any damages or
injury, whether for breach of contract, tort, or otherwise caused
by any failure of performance; error; omission; interruption;
deletion; defect; delay in operation or transmission; computer
virus; file corruption; communication-line failure; network or
system outage, or theft, destruction, unauthorized access, to ,
alteration of, or use of any record.
The formation, construction
and interpretation of this agreement shall be controlled by the
laws of the State of Tennessee - USA. The U.N. Convention of
Contracts for the International Sale of Goods is expressly
excluded from any interpretation of this Agreement.
Any dispute relating to
this agreement shall be subject to the exclusive jurisdiction of
the courts in Cleveland, TN, USA, and the parties agree
to submit to the personal and exclusive jurisdiction and venue of
these courts.
Superior-host reserves the
right to change or amend these Terms of Service at any time
without prior notice. By submitting your order to
Superior-host.com, you signify your agreement to these Terms of
Service.
Superior-host reserves the
right to suspend or cancel any hosting account that is not paid within 15 days after due date.
A backup copy of a site closed for non payment will be available for a fee of $40.00 plus unpaid hosting bill.
Cancellations
IF you wish to cancel your web hosting with us, simply call, or email us and let us know.
All unused months paid in advance will be refunded.
If you cancel within the first 60 days, you will receive a full refund.
NOTE: Domain name registration is paid to the registry and is non refundable.
However, the domain is yours to keep and move to any host.
If you do not agree to
these Terms, then please don't submit an order!
Violations of these
Acceptable Uses Policies and Terms of Service should be referred
to
admin@superior-host.com
All abuse complaints
will be investigated promptly.
Serious violations of
terms or conditions can be ground for immediate account
deactivation without refund.
